Elon Musk's artificial intelligence startup, xAI, has filed a lawsuit against OpenAI, alleging the theft of trade secrets related to its AI chatbot, Grok. The lawsuit claims OpenAI engaged in a "deeply troubling pattern" of hiring former xAI employees to gain access to confidential information, including source code and operational advantages in launching data centers.
The lawsuit names four former xAI employees: Xuechen Li, who is already involved in a separate trade secrets lawsuit; Jimmy Fraiture, an early xAI engineer; and a senior finance executive. xAI alleges that OpenAI targeted individuals with knowledge of its key technologies and business plans, inducing them to breach their confidentiality agreements.
Musk's lawsuit against OpenAI is part of an ongoing conflict between the two companies. Musk co-founded OpenAI in 2015 but left the board in 2018 after an unsuccessful bid to gain control of the organization. Recently, Musk filed a lawsuit against OpenAI and Apple, accusing them of anti-competitive behavior and preferential treatment of ChatGPT in the App Store.
OpenAI has rejected the allegations, dismissing the lawsuit as "the latest chapter in Mr. Musk's ongoing harassment." The company maintains it has no tolerance for breaches of confidentiality and no interest in trade secrets from other labs.
