Europe’s AI Act Is Moving From Rules to Enforcement

Europe’s landmark AI Act is entering its enforcement phase, marking an important transition from drafting AI rules to actually making companies comply with them. The European Union is now testing whether its broad regulatory framework can work in practice and whether it can become a global benchmark for how governments regulate artificial intelligence.

The immediate challenge is complexity. The AI Act introduces different obligations depending on how an AI system is classified, including transparency requirements that have now begun taking effect. Companies must understand which rules apply to their systems, document compliance and adapt products accordingly. Legal experts quoted by Axios warn that the framework is complicated, meaning implementation could be considerably harder than simply passing the legislation.

The regulation is also beginning to influence companies outside Europe. Anthropic, for example, has committed to watermarking content generated by future Claude models in line with the EU's requirements. This illustrates the potential “Brussels effect”: even companies operating globally may adopt European standards because maintaining completely separate systems for European and non-European markets can be inefficient.

The broader takeaway is that AI regulation is entering its real-world test. The debate is no longer primarily about what governments should regulate, but whether companies can actually comply without slowing innovation or creating excessive bureaucracy. If the EU successfully enforces the AI Act while maintaining a competitive technology sector, its approach could influence AI regulation worldwide; if implementation proves too complicated, it could instead become a warning about the difficulty of regulating technology that evolves faster than legislation.
