Experts Warn Texas Environmental Agency Isn’t Ready to Regulate AI Data Centers

Experts and community members in Texas are raising concerns about the Texas Commission on Environmental Quality’s (TCEQ) ability to enforce regulations for the rapidly growing number of AI data centers in the state. As Texas attracts major tech investment, critics argue that oversight has not kept pace with the expansion, leaving local communities potentially exposed to environmental and health impacts.

The TCEQ oversees permitting and enforcement related to air emissions, wastewater, hazardous materials, and water usage for industrial facilities. However, former agency staff and watchdog groups warn that the commission is already stretched thin due to limited staffing and funding. They caution that without significant policy changes and additional resources, the agency cannot adequately monitor compliance or protect residents from potential harms.

Local communities have expressed concerns about noise, air and light pollution, water consumption, and electricity demand linked to new AI data centers. Residents fear that rapid development could strain public utilities, change the character of towns, and pose hidden health risks.
